Shop Terms
General Terms and Conditions for the purchase of goods in the North Sea Ultra online shop
§ 1 Scope and Provider
These General Terms and Conditions (GTC) apply to all purchase contracts concluded via the online shop at northseaultra.com/en/shop/ between you and
SCNTSTS UG (haftungsbeschränkt)
Münzstr. 10, 10178 Berlin, Germany
Amtsgericht Charlottenburg, HRB 239363
Email: [email protected]
(hereinafter "Provider"). Deviating or supplementary terms of the buyer are not accepted unless the Provider expressly agrees in writing. These GTC do not apply to event registrations for the North Sea Ultra; those are governed by the Terms & Conditions.
§ 2 Conclusion of Contract
The display of products in the online shop does not constitute a legally binding offer, but an invitation to order. By submitting the order, including the subsequent payment authorisation, the buyer makes a binding offer to purchase. The redirect to Stripe or a payment status displayed there does not in itself constitute acceptance. The contract is concluded when the Provider accepts the offer by sending an order confirmation by email or by executing the order.
§ 3 Prices and Taxes
All prices stated are gross prices in EUR and include the applicable statutory VAT. No separate shipping charge applies unless it is expressly displayed before the order is submitted. Price changes are reserved until order confirmation.
§ 4 Payment
Payment is processed on Stripe's hosted payment page (stripe.com). Contact and shipping details are collected beforehand in the North Sea Ultra shop and, together with the buyer's name, email address and order number, assigned to an order-specific Stripe Customer record. At Stripe, the buyer enters the details of the chosen payment method and any verification required for that method. Accepted payment methods are displayed there. The payment provider's confirmation determines the payment status. While card payments are generally confirmed promptly, confirmation of a SEPA Direct Debit may be delayed; until then, the order remains in processing. The purchase price is due upon conclusion of contract.
§ 5 Delivery and Shipping
Delivery is available within the EU. Delivery time is generally 5–14 business days after receipt of payment. Letter-sized items are shipped as standard mail; parcel items via DHL. In case of delays, the Provider will inform the buyer by email. The Provider reserves the right to cancel orders in case of non-availability and to refund the purchase price in full.
§ 6 Retention of Title
The delivered goods remain the property of the Provider until the purchase price has been paid in full.
§ 7 Right of Withdrawal
Consumers have a statutory right of withdrawal pursuant to § 312g BGB. The full cancellation policy including the model withdrawal form is available at: northseaultra.com/en/withdrawal/.
§ 8 Warranty
Statutory warranty rights apply. The limitation period for material defects is two years from delivery. No second-hand goods are sold. For defect reports please contact: [email protected].
§ 9 Limitation of Liability
The Provider is liable without limitation for damages from injury to life, body or health and for damages caused intentionally or through gross negligence. Otherwise, liability is limited to the damage typically foreseeable under the contract. Liability under the Product Liability Act remains unaffected.
§ 10 Dispute Resolution
The Provider is neither willing nor obligated to participate in a dispute resolution procedure before a consumer arbitration board.
§ 11 Governing Law
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law only applies insofar as it does not restrict mandatory consumer protection provisions of the country of residence. Should individual provisions of these GTC be invalid, the validity of the remaining provisions is not affected.
